RockQuest Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the RockQuest mobile application, the RockQuest website, public rock pages and all related features and services (together, the “Service”).

Please read these Terms carefully. By creating an account, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are under 18, you must read these Terms with a parent or legal guardian. Where required by applicable law or by RockQuest’s age-safety rules, your parent or guardian must approve your use of the Service or perform certain actions for you.
1. About RockQuest
RockQuest is a real-world treasure-hunt service that lets users create, photograph, hide, discover, mark as found and re-hide painted rocks, share clues and comments, interact with community content and follow the journey of a rock.
RockQuest combines online content with activities in public places. The Service does not guarantee that a rock still exists at a displayed location, that a location is accurate, accessible or safe, or that access to a location is legally permitted.
2. Eligibility and child accounts
2.1 Age requirements
You may use RockQuest only if you are legally able to agree to these Terms or if your parent or legal guardian agrees on your behalf where required.
RockQuest may ask for your date of birth or an age range to provide an age-appropriate experience. You must provide accurate information and must not attempt to bypass age restrictions.
2.2 Users under 18
Users under 18 may be subject to additional protections and restrictions, including:
- parental or guardian approval, action or supervision;
- restrictions on publishing or exchanging freeform content;
- restrictions on profile, location or communication features;
- safety reminders before content is shared;
- a requirement that a parent or guardian hide a rock;
- limits on interactions with unknown users;
- additional content review or moderation.
A child must never meet an unknown person, travel to an unfamiliar location, hide a rock or search in an unsafe area without appropriate adult supervision.
2.3 Responsibility of parents and guardians
If you permit a child to use RockQuest, you are responsible for supervising their use, explaining these Terms and the safety rules, and ensuring that the child follows them.
Where you approve an action for a child, you confirm that you are the child’s parent or legal guardian, or that you otherwise have lawful authority to provide that approval.
3. Accounts
3.1 Account registration
Some features require an account. You agree to provide accurate, current and complete information and to keep it updated.
Your username must comply with RockQuest’s technical requirements and must not:
- impersonate another person or organisation;
- violate a trademark or other legal right;
- contain abusive, sexual, hateful, deceptive or unlawful material;
- falsely suggest that you represent or are endorsed by RockQuest.
We may require you to change a username that violates these Terms or creates a risk of confusion, harm or abuse.
3.2 Account security
You are responsible for protecting your account, device, login credentials and authentication methods. You must not share access tokens, passwords or verification codes with another person.
Tell us promptly through https://en.rockquest.org/contact-us if you suspect unauthorised access, account theft or another security issue.
3.3 One person, legitimate use
You must not create accounts in bulk, create deceptive or automated accounts, sell or transfer accounts, or use another person’s account without permission.
3.4 Account deletion
You may request account deletion using the in-app deletion function, where available, or through https://en.rockquest.org/contact-us.
Deletion and retention are handled as described in the RockQuest Privacy Policy. Some rock-journey information may remain in anonymised or de-identified form so that the shared history of a rock remains understandable.
4. Licence to use the Service
Subject to these Terms, RockQuest grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service for personal, non-commercial purposes.
You may not:
- copy, sell, rent, lease, sublicense or commercially exploit the Service;
- reverse engineer, decompile, disassemble or attempt to discover source code, except where applicable law expressly permits this;
- bypass security, access controls, rate limits or age protections;
- scrape, crawl, harvest or systematically extract data without written permission;
- use automated tools, bots or scripts to create accounts, submit content or manipulate activity;
- interfere with the operation, security or integrity of the Service;
- use RockQuest’s trademarks, branding or visual identity without permission.
All rights not expressly granted to you remain with RockQuest and its licensors.
5. Real-world safety rules
Your safety and the safety of others must always come before finding or hiding a rock.
5.1 General safety
When using RockQuest, you must:
- obey all laws, signs and instructions;
- remain aware of roads, vehicles, bicycles, water, heights, animals, weather and other hazards;
- use suitable clothing, equipment and adult supervision;
- respect other people, property, wildlife and the environment;
- leave immediately if a location appears unsafe or access is uncertain;
- never use the Service while driving or operating machinery;
- never rely on RockQuest for emergency, rescue or navigation purposes.
5.2 No trespassing
You must not enter private property, restricted land, closed buildings, construction areas or any place where you do not have permission to be.
A rock appearing on a map does not give you permission to enter a location.
5.3 Unsafe or inappropriate hiding locations
You must not hide or place rocks:
- on, beside or above roads, railway tracks or active transport routes;
- near cliffs, fast-moving water, deep water, unstable ground or dangerous heights;
- in construction sites, industrial sites or restricted areas;
- in or near electrical, utility, emergency or security equipment;
- in airports, schools, hospitals or sensitive facilities where the object may cause concern;
- on private property without the owner’s clear permission;
- where retrieval may damage property, plants, wildlife or protected places;
- where a painted rock may be mistaken for a threat or suspicious object;
- anywhere prohibited by law, site rules or a landowner.
5.4 Safe painted materials
You are responsible for ensuring that painted rocks are clean, non-toxic, environmentally appropriate, free of sharp edges and safe to handle. Do not attach batteries, electronics, food, drugs, liquids, dangerous materials or items of significant value.
5.5 Location accuracy
Locations and clues are submitted by users and may be inaccurate, outdated, incomplete or misleading. A rock may have been moved, removed, damaged or never placed.
RockQuest does not inspect or approve every physical location and does not guarantee the existence, condition, accessibility, legality or safety of a rock or location.
6. User content
“User Content” means any content you submit, upload, publish or otherwise make available through the Service, including photos, avatars, biographies, captions, descriptions, clues, comments, reports and rock information.
6.1 Your ownership
You retain ownership of your User Content and remain responsible for it.
You confirm that:
- you created the User Content or have all permissions required to submit it;
- the User Content does not infringe copyright, trademark, privacy, publicity or other rights;
- any person clearly shown in a photo has agreed to its publication, or you otherwise have a lawful basis to publish it;
- where a child is identifiable, all required parental or guardian permissions have been obtained;
- the User Content complies with these Terms and applicable law.
6.2 Licence granted to RockQuest
When you submit User Content, you grant RockQuest a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt for technical or formatting purposes, display, communicate, distribute and make the User Content available as reasonably necessary to:
- operate and provide the Service;
- display rocks, journeys, profiles and community activity;
- moderate, secure and improve the Service;
- investigate reports and enforce these Terms;
- create backups and ensure technical compatibility;
- promote RockQuest using public User Content, provided that we act reasonably and respect applicable child-safety and privacy requirements.
This licence allows RockQuest to use service providers to perform these activities on our behalf.
The licence ends when the User Content is deleted from our active systems, except to the extent that:
- the content has been shared with others and they have retained a lawful copy;
- temporary backup copies remain;
- retention is required for safety, fraud prevention, legal compliance or legal claims;
- rock-journey information is retained in anonymised or de-identified form.
6.3 Public nature of content
RockQuest contains public and community features. Your username, avatar, rock photos, captions, comments, clues, activity, journey information and certain location details may be visible to other users or on public web pages.
Do not post anything that you do not want others to see, copy or share.
6.4 Feedback
If you send suggestions, ideas or feedback about RockQuest, you permit us to use them without payment or obligation, but we do not claim ownership of any underlying intellectual property that you already own.
7. Prohibited content and conduct
You must not use RockQuest to create, upload, share, encourage or facilitate:
- illegal activity or instructions for committing an offence;
- child sexual exploitation or abuse material, grooming or sexualisation of minors;
- nudity, pornography or sexually explicit content;
- harassment, bullying, stalking, threats or intimidation;
- hateful or discriminatory content targeting protected characteristics;
- violence, graphic injury, cruelty or credible threats of harm;
- suicide or self-harm encouragement;
- dangerous challenges or reckless behaviour;
- personal or confidential information about another person;
- a child’s home address, school, telephone number, private email address, daily routine or real-time location;
- impersonation, deception, scams, fraud or misleading claims;
- copyright, trademark or other intellectual-property infringement;
- spam, unauthorised advertising, commercial solicitation or repetitive content;
- malware, harmful code, phishing or attempts to collect credentials;
- content intended to bypass moderation, age restrictions or safety controls;
- instructions, coordinates or clues that direct users to trespass or enter unsafe places;
- the manipulation of likes, comments, reports, discovery records or other counters;
- false reports made to harass another user;
- interference with another person’s rock or deliberate destruction of rocks;
- conduct that damages RockQuest, its users, its systems or its reputation.
This list is not exhaustive. We may act against other content or conduct that creates a legal, safety, security or community risk.
8. Moderation, reporting and blocking
8.1 Community moderation
RockQuest may use automated systems, human review or both to detect, review and moderate User Content and activity.
We do not undertake to review every item before it appears. The presence of content on the Service does not mean that RockQuest endorses or approves it.
8.2 Reports
Users can report content or users through the available in-app reporting tools. Serious or urgent concerns may also be submitted through https://en.rockquest.org/contact-us.
Reports must be made honestly and in good faith.
8.3 Blocking
The Service may allow you to block another user. Blocking can limit certain interactions but may not remove public content, historical journey information or copies already seen or retained by others.
8.4 Action we may take
Where reasonably necessary, we may:
- remove, hide, restrict or refuse User Content;
- reduce the visibility of content;
- disable comments, likes, location features or other functions;
- warn a user;
- require an account or content change;
- temporarily suspend or permanently terminate an account;
- prevent the creation of replacement accounts;
- preserve relevant evidence;
- contact a parent or guardian;
- refer a matter to law enforcement, child-protection services or another competent authority.
We will consider the nature, severity, frequency and context of the conduct. In urgent safety, security or legal situations, we may act without advance notice.
8.5 Review of decisions
You may ask us to review a moderation or account decision through https://en.rockquest.org/contact-us. Provide enough information for us to identify the decision.
9. Privacy
Our collection and use of personal data are described in the RockQuest Privacy Policy.
By using the Service, you acknowledge that location information and public User Content may be processed and displayed as described in that policy and in these Terms.
10. Intellectual property
The Service, including its software, design, artwork, text, branding, logos, databases and non-user content, is owned by RockQuest or its licensors and is protected by intellectual-property laws.
“RockQuest” and associated logos and designs may not be used without written permission, except where applicable law permits descriptive reference.
If you believe content on RockQuest infringes your intellectual-property rights, contact us through https://en.rockquest.org/contact-us and provide:
- your name and contact details;
- identification of the protected work or right;
- identification and location of the allegedly infringing content;
- an explanation of the claimed infringement;
- a statement that the information provided is accurate and submitted in good faith;
- evidence that you own the right or are authorised to act for the owner.
11. Third-party services
RockQuest may use or link to third-party services, including map services, identity providers, app stores, operating-system services and external websites.
Your use of those services may be governed by separate third-party terms and privacy policies. RockQuest is not responsible for third-party content or services that it does not control.
You must comply with applicable third-party terms, including the terms of your app-store provider, identity provider, mobile network and device platform.
12. App store terms
12.1 Apple App Store
If you obtained the RockQuest application through Apple’s App Store:
- Apple’s standard end-user licence agreement applies to the licence of the iOS application unless RockQuest publishes a valid custom licence agreement through Apple;
- these Terms are between you and RockQuest, not Apple;
- RockQuest, not Apple, is responsible for the Service, its content, support and claims relating to RockQuest;
- Apple has no obligation to provide maintenance or support for RockQuest;
- your use of the application must comply with Apple’s applicable usage rules and terms;
- Apple and its subsidiaries are third-party beneficiaries of the provisions that apply to the iOS application and may enforce those provisions as permitted by Apple’s terms.

12.2 Google Play
If you obtained RockQuest through Google Play, your use of the application must also comply with the applicable Google Play terms. These Terms are between you and RockQuest, not Google, except where Google’s terms expressly provide otherwise.
13. Service availability and changes
We aim to provide a reliable Service, but we do not guarantee that it will always be available, uninterrupted, secure or error-free.
We may:
- update, modify, replace or discontinue features;
- perform maintenance;
- impose reasonable usage or technical limits;
- remove inactive, unsafe or outdated rock records;
- change supported devices, operating systems or regions;
- introduce new safety, moderation or age-assurance measures.
Where a change materially reduces a paid feature, we will provide any notice or remedy required by applicable law.
RockQuest is not an emergency, navigation, rescue or public-safety service.
14. Beta and test features
We may make experimental, beta or preview features available. Such features may be incomplete, unstable or changed without notice.
You should not rely on beta features for important, safety-critical or permanent information.
15. Fees and purchases
RockQuest may currently be offered free of charge, but we may introduce optional paid features in the future.
Before a purchase, you will be shown the applicable price and material conditions. Purchases made through an app store are also subject to that store’s payment, cancellation and refund terms.
Nothing in these Terms limits any mandatory consumer right, including rights relating to faulty digital content or services.
16. Suspension and termination
16.1 Termination by you
You may stop using RockQuest at any time and may delete your account as described in Section 3.4.
16.2 Suspension or termination by RockQuest
We may restrict, suspend or terminate access when reasonably necessary because:
- you materially or repeatedly violate these Terms;
- your account creates a legal, safety, child-protection, fraud or security risk;
- you use the Service in a way that harms other users or RockQuest;
- we are required to do so by law or by a competent authority;
- continuing to provide the account or Service is no longer reasonably possible.
Where appropriate, we will explain the reason and provide an opportunity to appeal. We may act immediately and without advance notice in urgent cases.
16.3 Effect of termination
When access ends:
- your licence to use the Service ends;
- you must stop accessing restricted parts of the Service;
- provisions that by their nature should continue will remain effective, including provisions relating to ownership, content licences already required for retained data, legal compliance, liability and disputes.
17. Warranties and disclaimers
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Subject to those mandatory rights:
- the Service is provided on an “as available” basis;
- user-submitted rocks, locations, clues and content may be inaccurate, unavailable, inappropriate or unsafe;
- RockQuest does not guarantee that a rock will be present, that a location may be entered, or that content will remain available;
- RockQuest does not guarantee that every harmful item will be detected or removed immediately;
- you remain responsible for assessing real-world conditions and acting safely and lawfully.
No statement in these Terms requires you to waive a right that applicable consumer law gives you.
18. Limitation of liability
18.1 Liability that is not limited
Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- deliberate misconduct;
- breach of a legal duty where liability cannot lawfully be limited;
- any mandatory consumer right or remedy.
18.2 Foreseeable loss
If you use the Service as a consumer, RockQuest is responsible for loss or damage caused by our breach of these Terms or failure to use reasonable care and skill where that loss or damage was reasonably foreseeable.
We are not responsible for loss or damage that was not reasonably foreseeable when you accepted these Terms.
18.3 Business losses
The Service is intended for personal use. If you use it for a commercial or business purpose, RockQuest is not responsible, to the extent permitted by law, for loss of profit, revenue, business, opportunity, goodwill, anticipated savings or business interruption.
18.4 User conduct and physical locations
RockQuest is not responsible for the independent actions of users, landowners or third parties, or for physical conditions that RockQuest does not control.
However, this Section does not exclude liability where RockQuest is legally responsible and that liability cannot be excluded.
19. Your responsibility for breaches
You are responsible for your own conduct and User Content.
If you use RockQuest on behalf of a business or organisation, you confirm that you have authority to bind that organisation. That organisation will be responsible for losses reasonably arising from its material breach of these Terms, to the extent permitted by law.
Nothing in this Section requires an ordinary consumer to compensate RockQuest beyond what the law permits.
20. Changes to these Terms
We may update these Terms to reflect:
- changes to the Service;
- new safety, moderation or age-assurance requirements;
- changes in law, regulation or app-store requirements;
- security or fraud-prevention needs;
- reasonable operational or technical developments.
We will publish the updated Terms and change the “Last updated” date.
For material changes, we will provide reasonable notice through the Service, website or other appropriate means. Where required, we will ask you, or a parent or guardian, to accept the updated Terms before continuing to use affected features.
Changes will not retroactively remove mandatory consumer rights.
21. Governing law and disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you live. You may bring proceedings in the courts permitted by applicable consumer law, including the courts of your country of residence where such a right applies.
Before starting formal proceedings, we encourage you to contact us through https://en.rockquest.org/contact-us so that we can try to resolve the issue.
22. General terms
22.1 Entire agreement
These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, form the agreement between you and RockQuest concerning the Service.
22.2 No waiver
If RockQuest does not immediately enforce a provision, that does not mean we waive the right to enforce it later.
22.3 Severability
If a court finds part of these Terms unlawful or unenforceable, the remaining provisions continue to apply. The affected provision will be applied to the greatest extent permitted by law.
22.4 Assignment
You may not transfer your rights or obligations under these Terms without our written permission.
RockQuest may transfer its rights and obligations as part of a merger, reorganisation, financing, sale or transfer of the Service, provided that this does not reduce your mandatory rights.
22.5 No partnership
These Terms do not create an employment, partnership, agency, franchise or joint-venture relationship between you and RockQuest.

Section headings are provided for convenience and do not affect interpretation.
